Misdemeanor Convictions
Misdemeanor charges are less serious than Felony charges, however a conviction to a Misdemeanor will give a defendant a criminal record nonetheless. There are 3 types of misdemeanor charges.
An “A” Misdemeanor carries a sentence of up to 1 year incarceration and probation of 3 years.
An “Unclassified” Misdemeanor such as Misdemeanor DWI also carry a maximum sentence of 1 year incarceration and 3 years probation as well.
A “B” Misdemeanor carries a maximum sentence of up to 3 months incarceration and 1 year probation.
Throughout most of New York State, Misdemeanor charges are handled in the City, Town and Village Courts. An exception is Nassau and Suffolk County, where the majority of Misdemeanor cases are handled at the Nassau County District Court and the Suffolk County District Court. In New York City, these cases are heard in the New York City Criminal Court.
